General Conditions for Collaboration with Digital Media

• Herein, this document contains the fundamental aspects that all digital media representatives, bloggers, celebrities, influencers, (hereinafter referred to as collaborators), must accept and fulfil when making any contribution to digital media relating to Princess Hotels & Resorts, be it under the Princess Hotels & Resorts brand or with any of its other brands and/or hotels, products or services.
• The term contribution refers to any offer of visibility in digital media the accomplishment of which leads to some kind of benefit, upgrade, discount or gratuity in any of the products and services of Princess Hotels & Resorts, in compliance with the conditions determined by mutual agreement between the parties.
• This visibility includes publication of articles in blogs, mentions on social networks, joint organization of contests, publication of photographs, and any other form that involves the mention or publication of Princess Hotels & Resorts products and services in digital media not owned by Princess Hotels & Resorts.
• Each collaboration is covered by these general clauses, to which a few special clauses will also be added in order to define the specific conditions of the contribution, in which on the one hand the discounts or gratuities offered by Princess Hotels & Resorts shall be determined, as well as the exact and detailed considerations that are expected from the digital media, by way of example, the number of publications or the chosen theme; the collaborator is absolutely free to express his or her opinions and/ or contributions in all such matters.

General Clauses

• Under no circumstances may the established visibility of the products or services of Princess Hotels & Resorts be diluted among other brands in the same publication; such visibility is understood to be exclusive for the products or services of Princess Hotels & Resorts. In the event of an agreement being reached to prepare an article or a post, references to the products or services of Princess Hotels & Resorts will preclude coexistence with references to competing brands in the same publication; Fiesta Hotels & Resorts S.L. reserves the right to cancel the collaboration. Such a situation will only be accepted when the content of the post or the article grants unequivocal prominence to Princess Hotels & Resorts products and services. In case of doubt, the collaboration will be considered without any value, as will any discount or gratuity offered by Princess Hotels & Resorts, which must be reimbursed in its entirety.
• Were the agreement to include any gratuity or discount on our products or services for a specific date, the digital media may not publish any content from other establishments or brands that may be competitors of Princess Hotels & Resorts on the same day, namely: hotels, spas, beach clubs, restaurants or outdoor parties. If the gratuity or discount is applicable over several days, this clause affects each and every one of them, this being understood to include, in the same way, the day before and after the products or services have been enjoyed.
• The digital media must inform Princess Hotels & Resorts without limitation of any other agreements it may enter into with competitor brands that could be carried out on dates that are close to the visibility agreement (within one week before and/or one week after) prior to their signing the special conditions. In the event of non-compliance, Princess Hotels & Resorts, may reject the agreement without giving any compensation and may claim back the full amount of any products or services that may have been enjoyed, and any damages suffered.
• All visibility contribution made by the collaborator in digital media necessarily implies the prior and express acceptance of these general clauses and of the special clauses of the specific agreement, both of which must have the approval and written consent of at least one of these people: Pere Jordi Estivill – Marketing Manager
• The collaborator must at all times refer to the products and services of Princess Hotels & Resorts in accordance with the attributes of the corresponding brands; these attributes will be provided along with the special conditions of the agreement. In this way, the names of the brands, products and services of Princess Hotels & Resorts must be written and referred to by their full official names, as stated in the special conditions of the agreement; no abbreviations or simplifications will be accepted. If an error of this type were to be detected in this regard, Princess Hotels & Resorts will request that it is corrected as soon as possible, under the suspensive condition of the continuity of the collaboration and of each of the related obligations. A maximum period of 24 hours is established in which to carry out the subsequent correction.
• Whenever the special conditions of the agreement include one or more links to one or several Princess Hotels & Resorts corporate websites, each link must comprise the following logical structure: name + a hyperlink to the URL provided in the special conditions, and whenever possible, without any “nofollow” attribute.
• Both parties will be obliged to fulfil the special conditions; wherefore, in relations with third parties, the collaborators undertake to maintain confidentiality regarding the content thereof. Disclosure to third parties may be a cause for the cancellation of the collaboration, and may also authorize Princess Hotels & Resorts to claim the full amount of the products or services enjoyed, and damages suffered.
• All publications in digital formats, even when the collaborator has enjoyed the corresponding benefit, upgrade, discount or gratuity, can be cancelled if there is mutual agreement between parties, waiving the right of both the collaborator and Princess Hotels & Resorts to demand from the other party compensation of any sort, for any reason.
